What Happens When You Get Into A Rideshare Accident?

Motor Vehicle Accidents

Ridesharing is one of the great technologies of today. It’s extremely convenient and simple to use. Unfortunately anytime you get into a car you risk the chance of getting into an accident. Ridesharing is still fairly new and you may not be sure of the legal side of it yet. What do you do on the scene of the accident? How do you make a claim against Uber? Getting into any accident is extremely scary and you need to know the next steps to take.

What to do at the scene

One of the most important things you must do is get all the information you can from the accident. Presenting a lot of information can help you better with your claim. Get the name, address, and phone number of your Uber/Lyft driver. Also get this same information from the other driver(s) involved in the accident. Make sure you get vehicle information such as the make, model, and license plate number. It there were any witnesses to the accident, get their information as well. Make sure you take pictures of the scene. Take pictures from all different angles. Include things like the intersection, traffic signs within the area, and any damages they may have happened to the vehicles. In addition to this, you should use the regular protocol for car accidents. You should seek medical attention, even if you may feel that your injuries aren’t serious enough. A lot of symptoms can take hours or even days to present themselves. You should call the police so that you have a written police report you can bring to court.

How does Uber/Lyft insurance work?

If you are injured in an Uber or Lyft then you may decide to file an injury claim against them.

Even if your driver did not cause the accident, you can still make a claim. You can do this when a rideshare driver hits you as well. Typically in this scenario, the rideshare company should be able to compensate you for your injuries. The liability limits for these rideshare companies are fairly low. For example, Lyft has a limit of $50,000 per person’s bodily injury, $25,000 for property damage, and up to $100,000 per incident. In the state of California, the driver’s personal policy does not apply at all. Uber has a $1 million liability coverage.

Places like San Diego are popular destinations where Uber and Lyft are used frequently. Unfortunately, Uber/Lyft do not “hire” on the same basis as taxi drivers. Uber/Lyft drivers are not professional drivers so you run a higher risk of getting into an accident. Getting into a car accident is extremely scary. The whole situation can be confusing because of how fairly new this technology is. You need someone with experience in rideshare accidents. You need someone who knows the ins and outs of it and can get you the compensation you deserve. Ridesharing is a fairly new technology and the rules around it can be fuzzy. You don’t have to deal with the aftermath alone. Especially if you have gotten injured. You should be focused on healing. Contact our experienced San Diego car accident attorneys today.
