Workers’ Compensation Claims.

At Hiden, Rott & Oertle, LLP, we pride ourselves on making sure that our clients know exactly what to expect throughout the workers’ compensation process. We walk our California clients step by step through the initial meeting with us, the process of filing a claim, what the resolution of their case could be and when it could be reached.

Our Approach To California Workers’ Compensation Benefits.

Our workers comp lawyers have more than 50 years of combined legal experience. We are pioneering different ways for our clients in the San Diego area to receive additional benefits based on their individual situations. For example, we explore options related to things such as attendant care. If someone, typically your spouse, takes time off of work to care for you while you are injured, that person can get paid for his or her services, which are referred to as attendant care. This increases the total amount of payments that a family in a workers’ compensation situation can receive and can provide much-needed money to our injured clients.

We use the resources and experience of our firm to make the workers’ compensation process as simple and straightforward as possible for our clients. At the same time, we use creative solutions to try to get our clients paid as quickly as possible so they can focus more on their recovery, and less on their legal issues. During the process, we can also help you file for unemployment if you can no longer work.

Important Things To Consider in Workers’ Compensation Cases.

Our attorneys have several years of experience handling workers’ comp benefits cases in California. During that time, we have found that some of the major things clients should be aware of are:

  • Medical care: The workers’ compensation process can move extremely slow if you do not know how to properly navigate through it. This can delay your access to medical care. We help our clients streamline the process and file all of the appropriate paperwork for their claims. We also deal with the insurance companies that often slow things down.

  • Money: It can take insurance companies up to 90 days to either accept or deny claims, meaning there can be up to three months where you do not have any money coming in. To prevent this from imposing undue hardship on our clients, we help them find state programs that can provide income.

  • Adequate medical test: Following an injury, health care facilities customarily only perform an X-ray on the injured person. However, X-ray scans are not the most comprehensive diagnostic test these facilities can perform. When our clients contact us, we strongly push for the facility to conduct a magnetic resonance imaging (MRI) scan right away. Without this scan, it is possible that surgery or any other treatment can be delayed because the real cause of your health problems may remain hidden. These persistent health problems can also lead to missed time at work and even the loss of a job, so it is exceptionally important to get an MRI right away.

One Of Our Attorneys Can Answer Your Workers’ Compensation Questions.

Some of the common questions that we frequently answer for our clients are:

  • How much will I receive from workers’ compensation?

  • How often will I receive payments?

  • When do payments start?

  • When do payments end?

  • If my payments end, can they ever start again?

  • What are my options for a denied workers’ compensation claim?

In California, some of the potential workers’ compensation benefits other than the usual monetary payments can include:

  • For people who are seriously injured, a lifetime pension may be available.

  • Those who suffer catastrophic injuries may be entitled to a handicapped-accessible vehicle.

  • Retrofitting of a house for handicapped accessibility may also be available to those who suffer catastrophic injuries.

We try to work directly with insurance companies as often as possible to get these benefits for our clients. However, if the workers’ compensation process begins to move too slowly, we do not hesitate to get the courts involved as we protect our clients’ rights.
