Have you ever eaten at Tacos El Gordo? If you have, and we know that plenty of people in this area enjoy the restaurant, you may be disappointed with how they treat injured employees. We have learned that Cal/OSHA has ordered the popular food chain to pay $40,000 in fines “for failing to report a work-related injury and for maintaining dangerous work conditions.”

The fine was spurred after an investigation into an incident that took place earlier this year. It was learned that an employee fell of off a ladder and sustained serious injuries. During the course of the investigation, Cal/OSHA discovered that Tacos El Gordo:

  • Had 10 total violations
  • Failed to keep records of unsafe work conditions
  • Did not provide training for the proper use of portable ladders
  • Had inadequate first aid materials
  • Had no emergency eyewash station

At Hiden, Rott & Oertle, LLP, we know that this is all too common amongst workplaces – an incident happens and it is discovered that they are operating unsafely in multiple ways. None of this is good for employees. If you have been put into a similar working condition by your employer and been injured, you can count on us when you need a San Diego work injury attorney.

What Can Happen

It is absolutely vital that a strong partnership exists between an employee and their employer. This means that the employer should always provide proper training for their workers and should always ensure that they have the equipment necessary to do their job.

In the story above, training was an issue, as uncovered by Cal/OSHA. When employers attempt to ignore safety standards or outright lie about workplace injuries, workers are punished. There were around 2.8 million nonfatal workplace injuries or illnesses reported last year according to the BLS and some of the most common workplace injuries that cause people to miss days of work include:

  • General soreness or pain
  • Cuts, lacerations, or punctures
  • Sprains, strains, or tears

Workers in any industry can get hurt. It does not matter whether you are a factory worker, a firefighter, or an office clerk, the potential for harm is present. Not only are traumatic injuries a concern, but we also need to be aware of repetitive stress injuries and mental health illnesses that can be caused by workplace conditions.
