Earlier this year, the California Highway Patrol said that 35-year-old Justin Callahan was to blame for a fatal collision on the northbound I-5 transition ramp to westbound I-8. They said that thought he was going the wrong way in his Volkswagen when he collided with another vehicle, a Toyota Camry. The crash killed Callahan at the scene while two occupants in the other vehicle were seriously injured.

Callahan’s family had contested these findings.

Now, eight months later, the CHP has revised their findings now that they have concluded their investigation. They now say that it was the 22-year-old female driver of the Toyota who was to blame for the accident. The woman, who was also found to be under the influence of alcohol at the time of the crash, turned herself in to police last week.

At Hiden, Rott & Oertle, LLP, this accident shows us how scary and complex the aftermath of an accident can be. That is why we want to help you if you are injured in a wreck that was caused by someone else’s negligence.

When you need a San Diego car accident attorney, you can count on us to fight for the compensation you deserve.

THE BIG PICTURE

According to the California Office of Traffic Safety, there are over 250,000 people injured in vehicle accidents each year. Out of those:

  • There were more than 12,000 serious injuries
  • Over 3,500 people were killed

When we talk about serious injuries, we mean ones that can cause long-term disabilities:

  • Spinal cord injuries
  • Major internal organ damage
  • Traumatic brain injuries
  • Broken or dislocated bones
  • Severe lacerations or amputations

If we look closer at San Diego, more than 9,000 people were injured or killed in vehicle accidents during the same year.

If you find out that someone else’s negligence caused your accident, then you may wonder what your options are. If a driver was impaired by drugs or alcohol or was driving too fast for conditions, then you may be able to recover damages to help with expenses. The same can be said if they were distracted by their phones, either sending a text message or watching a video.

If a driver takes their eyes off the road, even momentarily, the results can be detrimental to other vehicles and people on the roadway.

We want you to know that insurance companies may call you very soon after an accident. You should not speak to them until you seek legal advice, especially if the other driver’s negligence caused the accident. Do not give them any information, including medical reports, until you speak with an attorney.
